Telehealth Consent & Emergency Notice

Informed consent terms for remote medical care, critical emergency notices, and state jurisdiction.

This document describes the terms under which telehealth services are provided through the Nectalis platform, operated by NECTALIS LLC as a management services organization (MSO) technology platform. Clinical care is provided exclusively by independent, licensed healthcare professionals. We recommend reading this document in full before completing the initial health assessment.

Informed Consent Terms

Nature of Remote Medical Care

Services are provided via telehealth, which involves the clinical evaluation of the patient through secure electronic means —synchronous video consultation or asynchronous assessment via health questionnaires— instead of a traditional in-person visit. Your evaluation, diagnosis, and treatment will be performed by an independent, licensed physician or healthcare professional, using the clinical information you provide.

Benefits of Telehealth

Remote care allows access to medical evaluations without travel, reduces waiting times, facilitates continuous treatment follow-up, and enables efficient coordination with licensed pharmacies for the dispatch of prescribed medications.

Technical and Clinical Limitations

Telehealth has inherent limitations: it does not replace in-person physical examinations, in-person laboratory testing, or emergency care. Technology failures (connection interruptions, poor audio or video quality) may affect the evaluation. The treating provider may determine, at their exclusive medical judgment, that you require an in-person evaluation before continuing with any treatment.

Confidentiality & HIPAA Protection

All patient health information is managed in accordance with the Health Insurance Portability and Accountability Act (HIPAA) and its applicable privacy and security regulations. Data shared during the evaluation is transmitted through encrypted platforms and used solely for clinical purposes, treatment coordination, and billing, except with the patient's express authorization or as required by law.

Medical Prescription & 503A Pharmacies

No medication is dispensed without a valid prescription. If and only if the treating provider determines that treatment is medically appropriate, an official prescription will be issued in accordance with state telemedicine laws. Prescriptions are sent to licensed pharmacies regulated under Section 503A of the FD&C Act. Nectalis, as an MSO platform, is not a healthcare provider or a pharmacy.

Right to Revoke Consent

You may revoke this consent at any time by contacting our team, without affecting the care already provided. Likewise, you have the right to request an alternative in-person evaluation or to decline any proposed treatment before it begins, without penalty.

State Jurisdiction Notice

Telehealth medical services are available in 49 U.S. states (excluding California), Washington D.C., and Puerto Rico, and are provided through the independent LocumTele medical network, composed of licensed physicians with active licensure in the patient's jurisdiction, and Rush Pharmacy, a compounding pharmacy accredited under Section 503A. Each jurisdiction sets its own requirements regarding the consultation modality (synchronous video or asynchronous questionnaire-based evaluation), and the platform adapts to those requirements. You must confirm your state of residence during the initial health assessment; a provider licensed in your jurisdiction will evaluate whether treatment is medically appropriate before any prescription is issued.

By using the Nectalis platform, completing the initial health assessment, and/or submitting a consultation request, you declare that you have read and understood this document, and you grant your informed consent to receive telehealth services under the terms described herein.
